My husband and I were just married and have filed I-130 and I-485 petitions. He has been here for one year on a student visa which is due to expire in a few days. My question is does he need to continue his studies in order to stay in status or does our marriage and AOS application make it legal for him to be here? Will not enrolling in an accredited school jeopordize our application? Thanks in advance for any input.

As long as you are married and his I-485 application is pending, he is in legal status in US. He does not need to continue his studies.
