Please advice me on H4 to H1

Hi,

I have 2 years 3 months exp in India. I got H1 approval in oct 2008. I went to India and came back to US on H4 in nov 2008.

Now I want to convert my status from H4 to H1.

My questions are,

1)I didnt have H1 stamping so far. I have only approval notice in my hand. I got approval with employer A. Can I change my status from H4 to H1 with Emploer B?

2)I didnt have US paystubs. (I have only Indian paystubs in my hand). Beacuse I never styaed in US on H1 (even a single day). So, US paystubs are necessary for H4 to H1 and H1 transfer?

1) Yes. You have to apply for change of status usin I-539 form.
2) H4 cannot work and they will not ask for pay stubs when you apply for H4 to H1 status change. For H1 transfer also you don't need pay stubs as you never worked.
