    Default H1B Extension urgent

    Dear good supportive member

    I have some question regarding extension because of my h1b will expire in Sep-2010, and I don’t want to loose my h1b visa

    1. Can I put file for extension my self If yes How ?

    2. Which and how much document needed for extension ?

    3. how much extension fees ?

    4. Can I put or send extension file to USCIS center while I am on home
    country?

    5. extension is not possible without involve to employer ?

    6. what is CBP COS and DOL ???

    please give me good suggestion

    >>> Same set of documents that were used for the first time H1B petition. In addition you will require latest pay slips, Client letter, project itinerary, documents related to employe/employer relationship etc. Check with your employer and/or their attorney.

    3. how much extension fees ?
    >>> ~ $320 for normal and ~ $1320 for premium.

    4. Can I put or send extension file to USCIS center while I am on home country?
    >>> Yes. Your employer can do that.

    5. extension is not possible without involve to employer ?
    >>> No. H1B is an employer's petition.

    6. what is CBP COS and DOL ???
    You could have googled for simple things like these.

    CBP - Customs and Border Protection
    COS - Change of Status
    DOL - Department of Labor

    Hi ,

    This is with reference to Question 3.

    I think in addition to 320$ fees - there is a fees of 1500$ or 800$ (depending on the number of employees in the company) which is basically a training fees is also charged.

    1.Is there fix 6 months time advance to file for extension of the expiration date ? if No, which time advance would be file for extension of the expiration date ?

    2. does any expiration date of 129 exist ? or it will be valid till to my h1 valid ??

    Yes, extension can be filed only 6 months in advance.

    They cannot file the extension before 6 months of your I-94 expiration. So, anytime within the 6 months from expiration of your I-94, an extension can be filed. (Visa is not important when you are inside U.S. I-94 is the one that decides your status).

    Thank you very much all good member I cleared my most of doubts

    till I have some doubts is below

    right now I am in home country since July 2008 and my visa will get expire sep - 2010 and my employer sent me current employment letter but I am still fear about POE...
    My plan to go to US in April middle...

    1. shall I go US in "in house" project with current offer(employment letter) letter ?

    2. is there happen any problem while on POE ? because of my h1 expire sep 2010 its short time...???



    please give me good suggestion
