    Question 2 questions regarding Eligibility Requirements for N-400

    Hello forum members!

    I meet the 5 year continuous residency, 30 month physical presence, and no trip longer than 6 months requirements, and have had my GC since 1998. However, I am currently abroad and won't be back in the US till May 19, 2010.

    Having said that, here are my two questions:

    First, can I file the N-400 form (send it in by mail to Dallas) while I am still abroad or must I wait till I am physically inside the US to apply?

    Second, if I must wait till I am physically in the US, must I wait 3 months till applying (to satisfy the "have lived in the state of residence for at least 3 months prior to filing of application" requirement), or can I apply right away since I have "lived" in my current home address for over 5 years? Basically I am not sure if "lived" refers to being physically present for 3 months prior or having had it listed as my permanent residency for at least 3 months prior to applying.

    You cannot apply while you are abroad, you have to still maintain the 3month rule to been in the state you wish to apply...

    Kind of a squabble if you ask me, but then that is USCIS for you... do it when you get back, you have waited this long, what do you have to lose..
