Returning Resident AFTER using visa waiver?

Hi all, hope you can help:

I have an expired Reentry Permit (own fault, the expiration date simply "crept up on me".) I have been living in India for 3+ years because my US citizen husband was assigned there with a US company. I am a German national, and we have 3 children with American passports. Now my reentry permit is expired, and we are planning a trip to the USA in 2 weeks.

Q: if I enter the US on the visa waiver program, will that suggest that I am "intending" to give up permanent residency? (I am not).
Q: can I still apply for a Returning Resident Permit AFTER I have entered and exited the US on the visa waiver?
Q: can I enter the US while Returning Resident application is pending?

I still need your help!

How do I retain permanent residency even if my reentry permit has expired and I will not be moving back to the US for a while (my kids and husband are all US citizens and I am a 'floater' with German citizenship, but we are based out of Asia where we are on tourist and/or business visas)?

Can anyone suggest a good immigration lawyer who can advise thoroughly without costing a fortune?????
