Default Filed I 485 with I 765 but forgot to include Photos for EAD

    Hi I'm a newbie.

We filed our I 485 2 days ago when we realized that we did not include extra photos for our I 765 (EAD). We were just reading some threads when we realized our mistake. Something that our lawyer should have checked and not overlooked....

Should we send the additional pics? We are really worried. Anybody who has been in this situation?

    Category: EB2
    I 140 filing date: July 20, 2010 Premium Processing
    NOR: July 23, 2010
RFE: July 25, 2010 Missing one page of I 140 form (lawyer's mistake)
    NOA: Aug 2, 2010

    Thanks

Sending it now will not do any good as they will not make it to your file soon. Just wait for the RFE and send them in. They will not deny it for missing photos.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.http://www.immihelp.com/visas/h1b/h1-visa-faq.html

Ahh on some sights and guides it only requires 2 passport photos for application and I know the other forms ask for photos too but you may not get RFE as they will copy them and place them with forms or if you get RFE then just post off what they require. Don't send anything till you hear from them as said in previous post. Good luck

Many people think of the AOS process as one big application. If you are submitting an I-130 petition, an application for Adjustment of Status, an application for EAD and maybe an I-131 Advance Parole, you need to treat each like a stand alone application. Read the instructions for each application and incude the evidence needed with it. Sometimes you are repeating things asked for on another application. It's best to clip the single application and it's supporting evidence together. Then put all the 3-4 separate applications together in one big envelope to send to USCIS. They will get shuttled off to different places/departments to be approved so that's why each should stand alone with the required documents/photos/etc.

About the photos for EAD. They actually use the digital photo they will take at the biometrics appointment on your EAD card. I don't know why they still ask for passport photos with EAD. Anyway, the lack of photos may likely be forgiven since they photograph you when you go for fingerprinting. I've read of others who made the same mistake and were not issued a Request for Evidence on the EAD or had their application rejected as incomplete.

I just did the same today.. I sent in my I-765 and didn't realize I needed to include 2 passport pictures. I believe everything else is correct though.
Was your whole application returned to you or did you get an RFE notice?
