Father I-30 and I-485

Hello,

I petition for my father and filled I-30 and I-485 together. They received my father file on August 12th but i did not receive any confirmation or receipt from them yet. How long it takes to get back from them.

My father I-94 is expiring on Sep 20th, Can he stay here if i did not receive any thing until then or what will happen.

Any help will be appreciated. Thanks

1. Timings vary. Therefore, you should wait.
2. It is not a problem as you filed I-485 before I-94 expired.

Hello,

Today i called USCIS they said my father has to go back to India if he did not receive his Green Card before his I-94 expire. I am really confuse what is should do now? They send whole file to India, it will take 5-6 days to get file from India and then it will take 1 day to submit the file to the Immigration office.

If he filed I-485, regardless of his I-94, he CANNOT leave the country. Just stay put and make sure you have your receipt number.
