    Default PD will be current in October, I-130 not approved

    Hi, I am a permanent resident. I filed I -130 for my husband. Priority Date is March 25th, 2010. According to the October visa bulletin my PD will be current next month. But my I-130 is not approved yet. My case is in the California Service Center and the are processing I-130s for spouse of LPR in 13 months. That means my I-130 will not be approved before my PD becomes current. Is there any way I can request for a expedited processing? Has anyone encountered this problem yet? Will appreciate any insight.

    Expedited processing is not avaliable for I-130. Have faith and lots of patience. Are you doing AoS or consular processing?

    Default Yes you can file AOS

    Now are you doing a Consular processing or AOS

    If consular processing then expedition is not possible. You have to wait for I-130 to be approved.

    If filling for AOS, yes you can file for I-485 while I-130 is pending. You file I-485 on the basis of filied I-130 and PD being current.

    If you call the CIS info line, they will give you wrong information.

    My friend, who is a LPR appiled for her spouse nov 2009. The I-130 was still pending (At the time of I-485 interview), and since PD was current they filed I-485.

    They successfully got I-485 interview and got approved. Their I-130 was approved just before the physical green card this year. Hope this answers the question

    My Husband is in Saudi Arabia. So we have to do consular processing

    Thanks for confirming that. This confirms and reiterates the fact that Expedited processing is not avaliable for I-130.

    If your PD goes current in the corresponding month then your best bet is to call up USCIS customer service and speak with them.

    My I-130 was approved on 09/16/2010. I haven't received the approval notice yet. But the status was updated on the USCIS website. Waiting for Case to be transfered to NVC.
