    Default EAD expired - Employer asked to continue in job while waiting renewal

    My Status I-485 in process.
    EAD renewal - Applied for renewal - receipt received; notice date: 9/07
    (initial EAD 1 year; 1st renewal: 2Yrs; 2nd renewal waiting for approval)


    My EAD has expired.
    Employer has asked to continue in my job while waiting for approval.

    Can any one advise me on the consequences?
    - Penalty for working on expired EAD?
    - Any deportation threat?

    It is illegal to continue to work on an expired EAD. Your employer is promoting illegal activity as they will be in lot of trouble for employing you illegally.

    For you, you could lose your ability to get the GC as any illegal employment is a huge negative. Don't even try it if you want to stay in this country.

    Report your employer to DOL and USCIS as they cannot force you to work on an expired EAD.

    Who plans on 245k? That is an exception which involves several hours of work from lawyers, appeals etc if resulted in a denial. No sane person will plan on using 245k and work illegally.

    Also, if you leave the country you could be denied re-entry as an Advance Parole can deny entry for any such thing on any day. As a parolee, you dont hold a status.
