    Default Finance case/Visa Denied

    I applied for my Fiance, he had an interview sometime in September,2010 during the interview process they had asked him to bring more Documentation which we did provide of all, after two weeks he received a letter stating that your Visa Petition was Valid for four months which is expired now and information provided was not conclusive,this is very disturbing to me so do I need to reapply again and how do I do that do I need to Resubmit another Application?.

    Your fiancé visa application is no longer in U.S. Embassy office. Please note that fiancé petitions expire four months from the approval date. The consular officer has the discretion to re-validate fiancé petitions if they expire during processing. However, since the consular officer was not convinced of the relationship in this case, the petition was not revalidated. It was returned to the National Visa Center (NVC) on October 26, 2010. Once NVC receives the petition, it will return it to the approving DHS office. Please direct all future inquiries regarding this case to the approving DHS office.

    My Concern is that I am very disturbed about this and very upset and what could I do? I have to apply again or what?

    Do you have any idea why they questioned the relationship?

    Never met face-to-face?

    HUGE age difference?

    HUGE socio-economic differences?

    Unusual cultural/religious differences?

    Too close familial relationship (cousins)?

    Combinations of any of these?

    Something else?

    Post From Tourist Visa to Fiance Visa

    Hi! First of all, I was very amazed on how people's questions were adequately answered here. This forum is definitely informative hence I decided to join and post my own concern hoping that you guys will help me out. Pretty please?

    I am a Filipina who is 23 years old. I met my boyfriend seven months ago in Jordan where we were both working. I know it sounds crazy to say that we already decided to get married even tho we've only been together for such a short time. Having said that, I came back to Philippines, he came here to meet my family and stayed here for 3 weeks and I applied for a tourist visa to come to Belgium so I can follow him. Ok, I know now that it was not wise for me to do that because my visa was denied. We didn't really realize how suspicous my application looked like.

    So now, we are considering to apply for a Fiance Visa instead. My concerns are these:

    1. Can I already re-apply as early as next month or do I have to wait?
    2. Isn't the embassy of Belgium going to accuse me of being fake about my real intention of going to Belgium? I mean, at first I applied for a tourist visa which tells that I have no intention of staying there and now suddenly I'm applying for a Fiance Visa just because my first application was denied.
    3. Is there a possibility of being banned from Belgium if they will accuse me of this?
    4. Is there a high chance that a Fiance Visa will be approved given that we haven't even been together for at least one year?

    Your response to this matter will be highly appreciated. This situation is really heart breaking to us. People may think that I'm just a typical mail-to-order bride from Philippines but I really am not. I am a career driven woman who is not from a poor family from a remote province (no disrespect intended). I even had to forget about my plans of pursuing a career in Cruise Ships or Airlines just for this. And as for the age difference, my boyfriend is only a year older than me.

    I really hope to hear a reply from any of you guys. Thank you so much in advance.

    Were you rejected on the tourist visa because you told them you intended on marrying the US citizen? Which was the truth and if so then yes you can apply for a fiancee visa. Is Your fiance Belgium or American?

    Thank you for your swift reply. But to answer your question, no I didn't tell them that we wanted to get married when I first apply for a tourist visa. But perhaps they thought that that was really our intention and that I don't intend to leave the Belgium after my visa expires and maybe that's why my Toursit Visa application was denied. So that's why I am afraid of being accused of deception if I re-apply for a Fiance Visa right after. We have already come up with a good alibi but I don't know if they are going to believe that. My relationship with my boyfriend is really genuine and we really love each other. We just hope they will believe that.

    My boyfriend is Belgian. I didn't realize that this is only for people with concern about going to the U.S. I'm sorry. I just thought maybe you can still help or share some thoughts even tho my guy belongs to a different country.

    If you are the USC then you will have to apply again for your fiancee to marry here in US as you let the other expire.
