    Default H1 Visa extension..Please help.

Hi All. I dont know if this scenario happened previously to any one. Please suggest me.

I was with Employer A and moved to employer B in aug 2010. My H1 visa stamping on my passport that I got from employer A is till Sep 2011. But when I moved to employer B, my I797 expiry date is till Aug 2013(So its an extension Right?). Now I'm planning to visit India in Jan 2011. So when I go to India do I need to go for a H1 Visa stamping? (From some of my friends I came to know its not needed) But I want to take the risk now itself. So is that OK if I go to the visa interview now?

    Please help me ...

It is not required for you to go for visa stamping now. You can still use the valid visa from that holds your previous employer's details along with the current I-94. By showing the extended petition at the POE, you can get a new I-94 that will be valid until 2013 (assuming your passport is valid until then).

However, if you want to get the visa stamping on the extended petition, you can still do that.
Not a legal advice. Use of this information is strictly at your own risk.
