I need your help regarding my I-485. I filed the I-485 at VSC with a
notice date of April 1999. I was married at that time, living in New
Jersey, and my wife's application was also included. In June 1999, we
moved to Seattle, but I was maintaining a private mailbox service in
NJ, and paying NJ state taxes. Our
I-485 application had the NJ mailbox address. On March 8th, 2000 we
flew to Newark, NJ, to do our fingerprinting, which was processed by
FBI and sent to INS within two weeks. In July 2000, INS sent a RFE to
send the Biographical data form and employer letter, which I did. At
the same time, since things were not working out between me and my
wife, we decided to go for a divorce. In August 2000, we went to
India, and filed a petition at the local court for divorce. My wife
did not come back to US, and is now living with her parents in India.
We are not on good terms and the only communication is through lawyers
in India. My immigration lawyer does not know about this development.
The divorce case is supposed to be held for hearing in August 2001, at
which time, if all goes well, we will be legally divorced. So far, I
have not notified the INS about the impending divorce.
In September 2000, INS asked me to file a new I-140 since my employer
was acquired by another company. The I-140 was filed, and approved in
December 2000. In December I moved to Columbus, Ohio from Seattle. My
immigration lawyer sent a letter to INS in January 2001, saying that
the I-140 had been approved and that they should approve my case. He
also did an address change, which I did not want him to do. I checked
the VSC phone message and it said that it might take 180 days to
process my case.
First week of February, 2001, I went to the local Ohio Senator's
office and met the person who deals with immigration. She said she
would check with INS and let me know. On February 9th, I got a letter
from her saying that VSC has transferred my case to the Cincinnati
office and once it is prepared for interview, it will be forwarded to
the Columbus office for an interview. She does not know how long will
it take. I then checked the VSC phone message and it said on February
6th, they transferred my case to Cincinnati.
I need your help on the following issues:
1. My fingerprinting was processed by FBI on March 16th, 2001. How
long will they be valid?
2. When they call me for interview, my wife is not going to be there.
What do I tell them about the impending divorce? Do I have to ask them
to withdraw my wife's application?
3. Will it help if I contact the local senator's office again and
request them to look into my case?
4. Will it help if I personally go the Cincinnati office and request
information on my case?
5. Any ideas about how long it might take and how to expedite it?
