Online work in USA, money deposited in India

  • Online work in USA, money deposited in India

    I am on a H1B visa and my wife is on a H4 visa.
    I am planning to do something online like adsense or affiliate marketing.
    Since I am on H1B, legally I will NOT be able to do that.

    So can I do any of the following?

    1.
    a) Give my India Residence in the Address information while registering
    b) Give my India bank account to deposit cheques or direct deposit from Clickbank or Google.
    c) I would pay taxes in India for this income.

    Que: Being and working in USA on H1B, is this legal in both USA and INDIA?

    2.
    a) Use my WIFE's name in all the needed places (Registration etc)
    a) Give my India Residence in the Address information
    b) Give my WIFE's India bank account to deposit cheques or direct deposit from Clickbank or Google.
    c) My wife would pay taxes in India for this income.

    Que: My wife has only H4, so can I do that? It will be like my wife is only working and not me.

    I will not be starting a company either in my name or my wife's, just using our personal bank account no.s to get the pay.


    3)

    a) Give my father/mother/friend details in all the places.
    b) Give their Indian account no. instead of mine or my wife's.
    c) Let father/mother/friend pay the taxes and also transfer the pay back to my India bank account.
    Assuming father/mother/friend is not working anywhere in India.
    In this case, I am no where in the picture.
    Also I can even get the pay back when I go to India after my H1B.


    Please provide you valuable suggestions.

    Also please suggest if there are any other alternatives to this.

    What you are trying to do is pure illegal. You cannot work for anyone else other than the company who sponsored your H1B. A person in H4 status is not suppose to perform any kind of work that will earn money.

    If your parents or a friend is operating the business from outside U.S, that is a different story. You cannot perform any kind of work in that business while you are in H1B status that is going to earn you money.

      Now that the first 2 options are totally ruled out.
      I wanted to get more of your opinion on the option -3.

      Assume that the money is sent to my mother's account in India.
      And I do work on a VOLUNTARY & FREE basis for her.
      Is that legal? If so, if she is being questioned later can there be a proper legal explanation she being a 60 yr old and a computer illiterate.


      Also, assume that my wife had a online company when in India and now she has moved to the US.
      Is it still illegal on my wife's part considering the fact that, she owns the company and was actively involved before coming to the US.

        1) You can only volunter for a non-profit organisation.
        2) When in H4, the candidate is not allowed to work irrespective of when/where the company is formed.

          A person working free for another person and that another person collecting money for that free work from third party can be interpreted as essentially working for money.

          A person cannot work while on US soil without work visa. If you go out of the country and then work for US remotely, it is a different thing.
