    Default H1 extension while few months left

    Hi,
    My H1B is expiring on May 4th 2011. I am on my 6th year of H1B. My 6 years in US will complete by JAN 2012. i.e only 8 months left after May 4th 2011 to complete 6 years.

    In the mean time, My Labor is cleared but 140 not yet applied.

    If i apply for H1B extension, How many months extension will be considered? 8 months or 12 months?

    Should i apply H1 extension first or 140 first?

    Any help appreciated.

    If you have an approved I-140, then yo can extend the H1B status for upto 3 years beyond the 6 year limit. If I-140 is pending approval, then you can get only 1 year extension.
