H1 Extension

Hi , I'm on H1B Visa in US.Both VISA and petition expires on Nov 15 2011.I need to travel to India for three weeks from August last week to September second week.I'm planning to file extension after my return. While I come back to US around Sept 15 , will I be permitted inside US considering I have only two mnths left in my petition and VISA ? Is there a way to file extension before my travel ? Is there any way to file extension while im in india ? Please let me know.

Extension can be filed maximum 6 months before the current petition expires. But if you file before you travel, make sure it is filed in premium so that you will get the decision before you leave. It is not advisable to travel while the petition is pending. Alternatively, your employer can file after you return too. There will not be any problems in your return with old petition.
