    Question Need Help----H1b transfer

    Hi to all member,

    I have applied for h1b transfer by regular process and received receipt from USCIS. After submitting documents to USCIS , I lost job from previous employer. and now, I want to start work for new employer within 2 weeks of loosing job from previous employer.(I need time to move to new place)

    I have two questions;

    1. Is the gap between jobs is OK (2 week for move to new place)?

    2. If my previous employer apply to cancel my h1b with USCIS, is there any effect on H1b approval with new employer? How much time it take to cancel current h1b with USCIS? (I am worried because I had applied for h1b transfer with regular process).


    Please help me by providing appropriate information.

    >>> When you are in H1B, you need to be working and getting paid. Unpaid vacation will show that you were out if status for a certain period. It is advisable that you keep the gap as minimum as possible. By the end of the year, your W2s should match the LCA approved.

    2. If my previous employer apply to cancel my h1b with USCIS, is there any effect on H1b approval with new employer? How much time it take to cancel current h1b with USCIS? (I am worried because I had applied for h1b transfer with regular process).
    >>> It should not matter since your H1B transfer was filed before the current employer files the revoke. You are allowed to work for the new employer with just the receipt notice.

    Thanks for your help again.

    I was working with my previous employer until 28 may and I applied for H1b transfer in the same week. I received my H1b transfer receipt from USCIS in next week of that( Means this week).

    I want to utilize the next coming week for moving and want to start work on
    12 th of June. My new LCA shows start date 05/16/2010.

    Do you think any problem will arise if I follow that plan?

    I hope not. Bur it is very hard to predict. It is just advisable to keep the keep the gap as low as possible.
