    Default H1B Visa revoked by the employer

    Hi,

    I would really appreciate some help here. My employment ended at the consulting company I was working with on July 08 2011. My employer has filed to revoke my H1b at USCIS on July 08 2011. I have my paystubs till July 08 2011 and my H1b is valid till Oct 2013. I have been giving interviews and looks like I might get an offer soon. Would I still be able to file for a new H1b visa by a new employer considering I do not have paystubs since July 08 2011 after my employment ended with my previous employer?

    Without the latest payslips, you are considered out of status on H1B. The H1B transfer will either get rejected without the latest payslips or the H1B will get approved for consular process (without a new I-94) which will force you to exit the country and return back with a valid H1B visa and the newly approved petition. The more the out of status period, the more the problem with future petitions, visa stamping and GC process.
