    Default Visa based on serious medical condition

    Hi,

    I've a very serious medical situation in my family.
    My 9 month daughter who born in USA and as per law by birth she is a US citizen.
    My daughter is suffering a very serious medical condition right from her birth, which requires daily medical treatment and life saving medical, she stays at a long term nursing medical care facility. Her condition does not allow her to travel any long distance journey.
    We would like to stay here in US to help support her and live with her.

    I'm currently working on H1B visa, which is expiring soon. My employer is planning to file my H1B extension, however because of the market conditions I'm have to move back to India.

    Question. Is there any way by which I can get the visa/GC or any other thing, based on my child medical condition, to help support her?

    Any help/direction would be a great help.

    You can try to change your status to Visitor using form I-539 and stay here with your daughter for up to 6 months. You can also consult an attorney if any other alternatives are available.
