    Hello Friends,
    I am in my 6th year of H1B. I accepted an offer from a new company and they transferred and extended my visa for another 3 years based on an approved I-140. However, just a couple of weeks before joining my new company they have withdrawn the offer on budget constraints. I have already resigned from my current company and can't go back there. I don't have a paystub from my new company but have recent paystubs from my old one. Can I transfer my newly extended H1B to a new company without paystubs from the current company who had petitioned for my visa?

    You need to keep working (for new or old employer) and provide paystubs until the day another employer files your petition. So if a new employer files immediately it may get approved with extension of status. This employer should show a copy of previous employer's petition approval to show that you are cap exempt.
