Default URGENT HELP NEEDED - F1 to H1 without graduation (dissertation work, still enrolled)

I entered in the United States for an MS degree. I completed my MS and continued for a PhD.

Now I have a job offer from a big company with a good salary and I will be working on my dissertation project at the company while working full time. I am also going to take (part time) dissertation hours at my university (which is a requirement for getting my PhD).

So, I will be working full time and enrolled in a university part time to get my PhD.

Because my dissertation will last for more than 12 months, I will not be eligible for an OPT.

I dont know whether I should be on a F1 - CPT 'thesis/dissertation' or should the employer file for my H1b (employer is willing to file). Could there be complications while applying for H1 in USA; or in India where I go for stamping?

Need your input asap! Any help is appreciated.

    Thanks in advance.

Your employer can certainly file H1 based on your MS or previous bachelor degree. While in H1 status, you must work full-time and one the side you can study or work on your dissertation as you please.
This is my opinion and not legal advice.
