    Default Visa Transfer

    HI,
    I have the below query:

    I have a US H1 Normal Visa from my current employer , now i am moving to a different company is it possible that my visa can be carried to the new organization by using the H1 visa transfer facility.
    Also does a visa transfer require approval from the current employer.

    I am guessing you are currently outside U.S. There is no such thing as visa transfer. However, any U.S employer can file a new H1B petition using the CAP from the old petition and request an immediate start date (You don't have to go through the quota again as you are already CAP counted). Once the petition gets approved, you can use the existing valid H1B visa in the passport with the new approval notice to travel to U.S and work for the new employer.

    Yes am currently outside US,Just wanted to confirm will the new employer require any approval or consent from the current employer for whom i currently hold the visa for.

    Default H1b transfer

    I am currently working in United States, employed by Company A on an H1b , got a new offer from Company B and filed for a transfer. which is pending. Now I have an offer from Company C that I want to join. Do I have to wait for approval from Company B to transfer to Company C and I still did not start working with company B so I do not have Company B paystubs and I am still working for Company A. Can I file my H1b for company C?

    Yes. You can file a transfer from Company A to C. Since you have not joined company B, you don''t need the petition or the payslips from them.
