    Hi,

    I am having valid B1 VISA..

    For getting a H1B VISA .there are 2 ways

    1. converting from B1 to H1b(COS)

    2. Or applying fresh H1 B petition. so that if H1b is rejected we still have valid. B1..

    Could some one help me to know which is better option in the current situation

    It is never advisable to file a COS from B1/B2 to H1B. You may face a lot of questions when you attend the visa interview the next time if a COS is filed. Better file the H1B petition was consular process and when that gets approved, get the H1B visa stamped and re-enter U.S to work for the H1B sponsor.
