    Default H1B renewal / passport expiry question

    Hi,

    My current H-1B is valid till 31st May 2012 and my employer is ready apply for a renewal/extention for another 3 years. The problem is my passport expires in the November of 2013.

    My question thus is, if I apply for H-1B renewal/extension now, will I get it for 3 years or will it be from June 2012 to November 2013 (just 18 months), which is when my passport expires?

    If it'll just be for 18 months, should I get my passport renewed now before filing for a visa extension? The problem here is that my country (India) doesn't allow passport renewals more than 1 year in advance of the expiry.

    Kindly advice.

    You can renew the passport only 12 months before the expiry date. USCIS and U.S Consulate are aware of this and it should not be a problem as long as your passport is valid for more than a year.
