F2 conversion to L1

Hi,

My spouse visits US every 6 months on F2 visa (as I am on F1). Her employer is a Multinational company (consulting company) and is present in US. While she is in India, she got an offer from US company. US Company is interested to file L1, however as majority of L1 is getting rejected, please advise if she can enter US on her dependent status F2 and then ask her US company to file L1 petition for her. Is it feasible option? What implications will it have?

Yes, that is possible. That does not change the possibility of petition denial and after that whenever she leaves the US and wants to return in L1 status, she has to get her Visa anyway. Also, she cannot begin working until L1 petition gets approved with change of status. Once change of status gets approved she must work.

2 to 3 months in regular, 15 days in premium.

Additional $1250 for premium processing, this fee can be paid by the employee.
