    Default H1 petition expired.

    Hello All,

    I have applied for H1 in 2007 and I got visa after a 221(g) admin processing. I have never used the visa. Also I have applied for H1 in 2008 again when the previous was in 221(g) status and also never came to US on H1. Currently i am on L1B blanket visa.

    My 2008 H1B petition might have already expired in Sep/Oct 2011. So if i want to apply for H1B now again, Can i apply in cap exempt or do i need to start freshly within the quota next year. Please suggest.

    You can be cap exempt. You will need the previous petition receipt number.

    Do i need to file the new H1 with the same employer who filed in 2008 with the receipt number or can a new employer file my H1 in 2011-2012 with the old receipt number.
