Default Can I apply for F1 with ongoing H1 B?

    Hello,

I am on H1 B and my H1 is valid until Aug 2012. I want to pursue MBA and course will commence from May 2012 (It is 2 years course). I want to apply for F1 just to make sure that in the worst case if my H1 gets expired and/or rejected, I must be able to continue my studies. Can I apply for F1 with my ongoing H1 B. If yes, let me know the procedure.

    Thanks much!

You can only have one status at any time. F1 or H1. On H1 you must work, but you can also study. On F1 you must study and but you can work on-campus only.
In case H1 status is ending, you can file for change of status to F1 at any time before H1 ends. But once F1 gets approved you must stop working for the H1 employer.
This is my opinion and not legal advice.
