    Default AOS and taxes, pls help

    rMy wife is filing for my visa, we have been married for a year and never actually lived together. Also,both of us are full time students; unemployed. for the affidavit of support form, do we need to have a joint tax return? how does that work if i never lived with her? also was she even suppose to file the federal tax, since she is a student, unemployed and living with her parents? her dad is my joint sponsor, is it ok if we just provide his last 3 year tax return.

    please help me with this, and thank you in advance for answering.

    Your posting is not clearly regarding what exactly you are trying to do.

    Is your wife sponsoring you for the green card?

    You don't have to file a joint tax return. You can file married, filing separately. Of course, if a person does not have a taxable income, he/she does not have to file any tax return.
