  • PIO card for minor. Need help

    Hi All,

    Me and my husband's visa expired on Oct 5th 2011. But my husband has I-94 till Feb-2014 and we didn't apply for L1 extension. I applied for L2 extension based on my husband I-94 on Sep 22nd 2011 and still waiting for response.
    Now we applied for my son's PIO (born on Aug21st 2011). PIO is not being processed and they informed they cannot issue either PIO/Visa to my son with out valid I-94 for both the parents.
    Need some help, how to proceed further in this situation.

    In that case, you should wait until you get your new I-94 with L2 extension and provide it to them.

    It seems that they don't completely understand the U.S. immigration laws. Therefore, they think only those who have valid unxpired I-94 in hand are legal in the U.S. That is not the case. However, there is no point in arguing with them.

      Thank you for your response.
      We are planning to visit India around end of Jan-2012 with our baby. Is there any legal alternative to get PIO/Visa for my son.
