    Default L1A visa from L1B

    Hello,

    I have a valid L1B till July 2012.
    My also have a valid L2 till July 2012.
    My son had visa till July 2011 and then it was extended till July 2012.

    Now I have come back to India as I am nearing 5 years on L1. Since I am already performing a managerial role, I am applying for a L1A visa.

    Should my wife and son go for fresh L2 with me or can they continue with existing L2 visa?

    You can apply for L1A extension from within US..unless you wish to stay out for 1 yr and recapture the entire 7 yr term. Either ways since their L2 is linked to the underlying L1 petition (which is undergoing a change) i think its better they apply for a L2 with you

    There is no need to apply for new L2 Visas if their current Visas are valid.
    Moreover, they can live in the US as long as their I-94's are valid and you are maintaining L1 status (A or B or employer does not matter).
