Have been living away from husband since past 3 years now. I am employed. My son in 5 years old and he is US citizen. My husband is US citizen..I have green card which is not more valid i believe since I have not visited USA and not fulfilled the requirement for its maintainence..
My husband has filed for divorce in USA court. Should i go ahead and apply for divorce here in Indian court with help of lawyer? What are chances of getting alimony and maintainence for my son and self ? If my husband refuses to pay any amount and simply asks for divorce. My lawyer suggests that it will be a favour by my husband if he agrees to give some amount. I have no rights now to claim the money. If i do i will have to face lots of problems since the US court can send a law person here in India to enquire about my son and will be forced to attend court proceedings in the USA. I am married according to Hindu Family act and registered marriage..
I want to know what are my rights now and should i trust my laywer. Pleae advice
