Travel on VWP while visa in AP?

My husband is on L1 status and our visas are in administrative processing since we travelled home to United Kingdom for the Christmas holiday.
Can we travel back to the USA on VWP if we declare our visa situation to ESTA?
We have personal possessions there and bills to pay, bank accounts etc. If our visas get denied or if the AP process takes months to resolve, we need to visit USA to collect our possessions etc.
We had built a life there and we cannot leave it without winding up our affairs.
We know we cannot continue to work without valid visas.
