    Default Visa for Newborn in India

    Sorry if this question was posted earlier. My wife has to go to India for delivery. I am on EAD now and not on H1. If the baby is born in India, whats the visa I need to apply for the baby to come back to US. I guess they wont issue a H-4 as I am not on H1. Please let me know.

    What is your current legal status?

    I am not on any visa at present. My H1 expired and I work on EAD now. Still not sure how to bring my baby back to US once born in India.
