Thread: L1B extension

    Default L1B extension

    My L1B is expiring by 31st March 2012. My employer would be filing for L1extension. My I-94 is valid till Dec 2014. Can i stay in the US past my L1B expiry date, based on my I-94 validity. Will i be out of status if so?

    Appreciate if someone can get back to me on this

    Your company cannot apply for L1 extension unless your I-94 is expiring within the immediate 6 months. As your I-94 is valid till 2014 it wont be possible to file for extension. In my opinion, it is not required do so currently as you are legally allowed to stay till your I-94 expiry and you will not be out of status till that time. The only future issue I foresee is that in case you are required to travel to your home country after 31-March-2012, you will not be able to enter US without getting a new visa stamping done. This is my opinion, please do consult experts too.

    Visa is only required for traveling to US.
    I-94 determines your permitted duration of stay. In fact, there is nothing for your employer to extend as I-94 expiry is more than 6 months away.
