  • OPT extension and H1B

    I am currently on OPT extension working as a consultant. My client does not participate in everify but my employer does participate so I am good there. My extension will expire in Nov 2012. My client is willing to sponsor my visa is April but the problem is H1B will only be effective from Oct 1 2012. So my question is after my H1B is approved can I request through my school DSO to USCIS to make a data fix in SEVIS and consider me for a cap gap until oct 1 2012 so that i can start working for my client in April 2012.

    No, it does not work that way. The earliest you can start is on Oct 1.
