Thank you so much for your info.

Right now we are only looking for one option, whether we can process her transfer F1 to H4 being here. But the only thing is I have to find a right lawyer to file this.

How about transfering to another university, I know they have to reinstate their sevis. Is it a good option ?

Yes She did get an RFE and the decision was pretty quick I think around 2-3 weeks after submitting the docs. She applied for OPT in Nov 2011. Are you in UNVA too? I am following their Facebook page and it looks like almost everyone who applied for OPT after Feb 2012 are getting their OPT cards with out any RFE. Even the people who worked on CPT. Only unlucky bunch are the people who applied right after the whole mishap(Oct 2011 - Jan 2012). It is so unfair that similar cases get different decisions from USCIS. I am thinking of taking some kind of legal action regarding this. I am planning to contact ****** Law Firm or some other Immigration lawfirm to see if they can file a class action suit in this matter.

it was really helpful that you replied me. ya, u r right, they are so wierd in making decisions .
so, when you got an RFE , did you reply through a lawyer or by yourself ?

so, if the OPT gets denied can i again go back to another university or I have to leave the country ?
