Thread: I-130

    Default I-130

    Hi,

I am new to this forum. My Dad has been a US Citizen for approx. 15 years. He filed an I-130 visa for me as an unmarried son last February (2011) and when I checked they were processing applications that were sent in June 2011 so have I been missed out? I am from the UK.

My question is I now have a fiance who I am very much in love with and wants to move to the US with me. Does anyone know how I go about this? She is a UK Citizen. Would I be able to marry her before I get my visa etc or am I better waiting until my visa is granted and then doing it? Is it just as simple to file a new application as a married couple (if we marry in the UK) or am I better continuing my current application then getting to the US and have her join me somehow?

I am confused but we both want to move to the USA as soon as is possible without being apart.

Any help or advice would be greatly appreciated.

    Thanks.

Why didn't your father petition you 15 yrs ago? How old were you when he became a US citizen?

You should have received an approval notice already, have you?

Current VB for F1 (your category) is April 1, 2005. If you marry you will move to category F3 wih VB 2/15/2002 which translates to approx 3 years of delay for you to get GC.

It was never a possibility back then as I was staying in the UK to finish my education/University degree. I am now 27 years old. I haven't received an approval notice yet. It still says pending on the USCIS website.

I don't understand what VB means. Am I better off getting my Father to re-apply for me as a married son if I marry my fiance in the UK?

Realistically, when can her and I move to the USA together?

(Sorry for sounding stupid, I'm new to all this stuff).

VB means Visa Bulletin. It shows the priority dates that are now current (meaning visa is already available for those people with PD less than the VB date).

No need to reapply. Once you get married your case is automatically converted from F1 (unmarried son/daughter of US Citizen) to F3 (married son/daughter of US Citizen) category. This way you retain the original priority date.
