    Hi -

    My parents received Green Card couple of years back ( in Jan 2010). After getting the green card approved, they came to US, received the official plastic card, applied SSN, .

    They stayed with me in US for more than an year. They left to India in Jan 2011. I have filed taxes for 2010 claiming them as my dependents .

    They came back to US on December 2011. During the entry at port of entry, the immigration officer asked some questions and stamped "407 advised" on their passport.

    Questions:

    1. What does "407 Advised" mean ?

    2. They are planning to go back in May (which makes their stay period for 5 months and 20 days). They are planning to come back in October (less than 6 months). Will it be a problem ?

    3. Can applying for I-131 (re-entry permit) be of any help ?

    Any help is really appreciated.

    Form I-407 is "Abandonment of Lawful Permanent Resident Status". It is a note the CBP officer left for the next CBP officer they face when entering the country again. In short - the CBP officer doesn't think (as it is clear to everyone here) they're actual residents - they're just using their GC as a "border crossing card"

    So in short - they will probably have problems next time they leave & try to enter the country after staying for anything else than a short time outside the country.

    Feel free to make them apply for a reentry permit - but if they plan to keep doing this (staying 6 months or less, leaving for more than a month) - I don't see this ending well.

    Make them make up their mind where they want to live.

    Thanks for the advice. I will follow and apply for re-entry permit and hope for the best.
