    Default 90 days no employment OPT

    Hello,

    My wife recently completed her masters in USA (F-1 visa) and is on OPT status now.

    Her first 90 days on OPT status will get complete on May 15, 2012. She has not got a job offer as of yet. She has her college graduation on May 19, 2012 (four days after the completion of 90 days period).

    She is planning to attend graduation on May 19th and then go to India for an important family visit. She would then apply for H4 visa in India.

    Is she legally allowed to stay back for a week after the 90 day OPT starting period when she has no job offer?

    Will this one week overstay be an issue when she applied for H4 visa later?

    Any help would be greatly appreciated!

    Yes, that is fine.
    Also, many people manage to save the OPT by doing internships (even unpaid), sometime with their school or advisor.
    This is my opinion and not legal advice.
