  • Changing from F1 to B1 , what are the supporting documents ?

    Hello There, I am an int'l student(under F1) currently using my OPT that is to expire end of May 2012, I am given 60 days grace period that is July 30 2012 , so I have a very close friend's wedding in September 8 that I would like to attend .. I was told that I need to apply to B2 visa and need to file I 539 by the immigration office. I am gonna do all the paperwork by my self so your help is very appreciated. What are the supporting documents to attach with I-539? like sample cover letter and I-94 and a copy of passport?is that it? and etc..what is the minimum length of extension I should apply? Can I e-file all of them together?

    Please respond as early as in your convenient!!

    copy of passport, copy of latest I-94 both sides, copy of Visa if any, copy of EAD card, copy of I-20, SEVIS fees receipt, a job letter/paystubs showing that you were employed, wedding invitation, informal letter from your friend, cover letter explaining why you would like to change to Visitor status, bank statements showing your ability to pay for your expenses.

      the bank statement is already written on my I-20 and a wedding invitation makes sense I read on blogs saying I need to prove that I am gonna leave the country so a return flight ticket but I don't want to buy my ticket this early and pay the change fee if my visa doesn't get approved?
      thanks for the advice , I know this is not a legal advice and I am trying to do all the paperwork by myself anyway cause the attorneys are asking way too much MONEY...thank u very much again

        The availability of funds on your I-20 is for during your studies. You still need to provide evidence of available funds to support you during your B2 Visit. Return ticket is not needed.

          but I am under f1 and my parents are still paying my expenses so it is going to be same paperwork? and do u know what is the shortest length of stay the USCIS usually gives?

            Bank statements from whoever is going to pay for your requested extension period.

            Approved duration of stay in Visitor status will depend on what you ask for and what is reasonable based on your reason for the request. The maximum is 6 months.

              I asked my parents for the bank statement but it will take a week to receive it what If I file it without a bank statement since it is already written on my I-20 and I want to extend my stay for only 2 months..I know this is not all legal advice but I am applying for a B2 from F1 as a change and my OPT will expire end of MAY so I don't want to file end of next weekend any advice on that?

                Do you have sufficient money to support yourself for the 2 months in your own account? If so you can attach your own bank statements.
                The amount on I-20 is irrelevant. They don't want to see if you could support yourself during your studies or OPT. They want to see how you plan to support yourself in the future (in the extension period that you are requesting).
