  • I-94 date extension for dependent

    Hi,

I have a valid I94 till 2014 but my L1 visa is expiring on June 2012.

My dependent L2 visa also expiring on June 2012 and they are coming next week.

    My query is:
    - Can I file for I-94 date extension or L2 visa extension from my dependent, if they get the I-94 date till June 2012 only (Note: I have not extended by L1 visa and will be on I-94 in future)?
    - Can there be any problem to file I-94 extension or L2 visa extension, if only 1.5 months are left from dependent I-94 expiry?
    - Or is there any other way to get the extensions of I-94 date for dependent?

    Regards

    >>> L2 cannot be extended based on your I-94. Unless you have an extended L1 petition, L2 cannot be extended.

    >>> Should not be an issue. You can eFile it and then send the documents later.

    >>> There is no other way. You need to get your L1 petition extended first. If your dependents carry your extended petition, they will get an I-94 matching your extended petition expiry date at the POE.

      Thanks for your reply...

      One more query,

Can't I extend the dependent I-94 date based on my I-94 date (which is valid till 2014)??

Note: My L1 visa is not on extension; I will be staying in US on I-94 date after June 2012.

And can my dependent request at POE to give I-94 date (to my dependent) based on my I-94 date?

      Please suggest.

      Regards,

Your dependents cannot get I-94 based on your I-94. It doesn't work that way. Their I-94 can be extended only based on your valid approval notice. This is one big problem with L1 blanket as the primary holders usually get I-94 based on the blanket petition (3 years) irrespective of its expiry date.
