    Default H1B Extension options beyond 6th year

    Hello All,

    Here is my situation. 6th year expiring in Aug 2012:

    1. Filed Labor before 6th year starts
    2. Labor approved during 6th year
    3. File I-140 under normal processing during 6th - Waiting for approval

    Will i be eligible to get 1year extension based on my Labor approval. Or should i convert my I-140 application in premium processing so i get the status in 15 business days?

    Your feedback would be appreciated on this.

    You can get extension based on Labor.
    This is my opinion and not legal advice.

    H1b cannot be extended with PERM approved unless I-140 has been pending for 365 days...this is listed in wiki, us government website, etc...I am facing same situation and my lawyer told if PERM is approved, 140 has to be approved with only above exception. thats why there is premium processing for 140..

    not intended to challenge you but just sharing that you might have to cross check that again as it is definetly not true from what I have seen and been told.
