Thread: Visa

    Default Visa

Hi I had B1 visa for 10 years and 1st time when I wen I stayed there for 7 months( Filed Extention) after that I did not travel for 3years. 2nd time I went and I was not allowed entry as they said my agenda was for 4 months and they said we cannot allow you for 4 months and I withdrew the application. They cancelled my visa and I was sent back to India. Can I apply a new visa from the same company. Please advice.

    Regards,
    Shank

They stopped you just because your business agenda was 4 months?
    Does not seem understandable.

Are you sure they did not mention anything about your your first visit? Overstay or something?
Was your extension approved the first time or did you leave US before the extension response came?

When I went to the Immigration Counter, they asked me how long you intent to stay and the purpose. I sadi my agenda is about 4 months and I have come for knowledge transfer. He immediately called another officer and said (this gentlemen needs 4 months for knowledge transfer)

Are you sure knowledge transfer is within the scope of B1 visa?
Because they go to this extreme step of canceling the visa /sending you back ,
only when there is a past violation or current intent is beyond the scope of the type of visa.

Anyway, you can surely apply again through the same company. And at the interview,
tell the officer exactly what happened.

It was unfortunate what happened to you, but can you please share what happens when
they do this, I mean where do they send you to wait for the next flight home? Is it at the airport
and how long did you wait for the next flight?

I reached Boston around 2PM and my flight to Albany was around 5.30 they made me wait till 10.30PM the next flight and they didnt give me my passport there were 2 cops with me untill I board and they gave the passport to the pilot and I got down in Paris and I was in the refugee home as my next flight was next day morning. I was treated like a prisoner. When reached India again they made me wait for 3 hours and then left me. It was a horrible experience.

    Sorry about your experience.

I suggest you talk to a good immigration lawyer over email before you apply for the visa.
Because he will guide you how to present your case at the interview
in the light of past experience and also to make sure this thing is not repeated.
