Hello friends.. I am looking some advice..
I am currently working in California on H1B visa. My previous employer based in New Jersey has filed a lawsuit against me in court of New Jersey six months after I moved on. My previous employer had processed my H1B visa while I was in my home country and I had signed an Employment Agreement with them. One of the clauses of the agreement was that I would have to serve 3 weeks notice before termination of employment, otherwise I would be liable for any damages that they might incur.
After completion of my project at the client's site, my employer could neither find a new project for me, nor had any thing in the pipeline for the next 2 months . For one month I was made to sit idle at home. It was very important for me to be on a project and have a client letter, as I had plans of travelling to my home country and had to get my visa stamped during my visit. Hence after one month of being idle, I resigned with immediate effect without serving the notice period. I don't think it would have caused any harm to my employer since they had no new project for me. After my resignation, they did not pay me 15 days worth of salary and also withdrew the last drawn salary from my bank account.
I am looking for some advice from people who might have been in similar situation. Any contact for a good attorney to help me reply back to the notice would be greatly appreciated.
