Default Denied because of misinformation

I applied, thru a lawyer, for citizenship february 2004. Went to my interview january 2005. I passed everything and then the ins official tells me I applied to early.. I returned to U.S. in December 2000 after being out for 1 year and a month with a reentry permit, therefore I was not eligible to apply until december 2004 (or 3 months prior).... Now, I don't remember being out that long, but the passports don't lie...my problem is why did my lawyer not advise me of this...why did he let me shell out 800 something dollars too early.. and why did he put in the n400 application sent.. that i was out only 50 days when really it was 1 year 1 month.... What can I do now... it's been a week now since the interview, the officer didn't make a decision yet... can i take any action against the lawyer for this misinformation... Can i write letter to someone explaining I was led to believe I was eligible...
any help..thank you would be appreciated
