Confused
Hi guys,

So I did my interview earlier this month. The IO was very nice.
She said everything is ok but there is an issue.

She stated that on my visa application, I stated that i was married. I told her i was never married.
She then read the information which stated that i was in a common law marriage and said that i needed to get proof that i truly wasn't.

My husband started working at it right away. We received it and want to send it but USCIS sent a letter that says THEIR RECORD shows that i was married. The IO read to me that i was in a common law marriage, not a certified marriage so along with the No impediment i want my lawyer to also provide an affidavit asking them to review THEIR RECORDS because no such information exists.

The reason i want him to do so is because, i don't want them to think i lied to obtain a visa because it is believed in my country that if you're married you're quicker to get a B2 visa because they think you will want to go back home to your spouse instead of overstaying. I didn't lie. I stated i was in a common law relationship.

Now my husband is saying that i might complicate the case if the lawyer should write the letter.

Please, what do you guys think i should do??

Thank God green card in hand!!
Hi guys first of all I want to thank God for all his blessings he has provided. God is good all the time. Today 12/20/17 I received my green card!!! I feel very blessed and fortunate that my process went very quickly. Don’t feel discouraged and have faith and lots of prayers. Here is my timeline. (For my previous AP travel experience see my profile previous experience posts) I’m from Washington State, Field Office Yakima.

08/08/17 Filed for AOS through my US Citizen wife (Lawyer didn’t send my packet until last week of August)

9/8/17 USCIS received my application for AOS (Permanent Resident), my EAD renewal application and AP application

9/24/17 received BIO appointment letter (the appointment was schedule for October but I decided to go next day. My lawyer said people are allowed to go before scheduled appointment date)

9/25/17 I went for BIO everything was successful

11/2/17 received notice for interview scheduled on 12/8/17

Received Combo AP/EAD Card 12/5/17

Interview with IO 12/8/17 Yakima WA field office was approved on spot. It took about 40 mins with officer. Swore us in both my wife and I. Took my photo and both index fingerprints. Then asked simple questions like what our full names were, DOB, our address, how we met and where, when did we get married and where. Then the officer asked Yes or no Questions from the application. Handed over some documentation to prove we were still married and living together, like bank statement, letter from landlord. The officer already had all my other evidence from my application I submitted ( this was our marriage certificate, bank statements, lease agreement, photos dated from 2008 through 2017, tax returns with both our names, copy of passports and birth certificates) She was a very nice officer, we made some small talk and jokes and then afterwards she said she didn’t find any reason not to approve me and that I should be getting my green card in a few weeks (approved on the spot) She then gave me information about my new status of a permanent resident and what to expect and also how I need to file to remove my conditional part from the green card (since we only have been married for less then 2 years) and steps to how to become a Citizen. My wife and I were super happy and did a little celebration dance in the lobby afterwards which the officer and my lawyer approved and laughed about it :)

December 15, 2017 received approval notice of permanent residence application

December 20, 2017 i received my Permanent Resident Card thanks to Jesus Christ all mighty.

I felt like my whole process went really fast especially since I was told from my lawyer that to expect my case to be solved and have green card between 6-8 months! So I was expecting my green card around late April or May 2018 but got it sooner! I feel very fortunate and blessed! I can file for citizenship in 2 years and 9 months which I will be doing! FYI the whole time of this process my online tracker never changed! It always kept saying and still says “on September 8th 2017 we received your applications” so don’t feel discouraged people about the online status not changing. Hope the best for all and god bless all!

AOS Interview Cancelled by USCIS
Hello all,

I am on F1 visa married to a US citizen and filled for GC on 06-01-2017.

Priority Date : 06-01-2017
biometrics : 06-23-2017
RFE on my DOB certificate : 07-11-2017
submitted : 08-20-2017
EAD on : 09-25-2017
Interview notice: 10-25-2017
Interview date : 11-30-2017

There it all started. I got a call from unkown saying that my interview got cancelled and will be resecheduled and its notice will be sent thru mail. But, I didn't believe as USCIS doesn't call anyone and status still saying that "Interview Scheduled". So I attended the Uscis office on interview date inspite of knowing that interview is cancelled. After I entered, the receptionist gave us token number and I was happy. Later within 5 minutes she called us back saing that interview is cancelled. I peek into her schedule papers, I can see my name as last serial number which strike out with green pen.

My question is Why it is cancelled.? when they will reschedule it.? Does anyone had this experience.?

I called USCIS customer service, they dont have this information that interview is being cancelled nor the reason. Local office made this cancelation. She said they might have done due to lack of officers.

ANY HELP OR ADVICE IS HIGHLY APPRECIATED.

On December 20, 2017, we updated your name for your Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, Receipt Number LIN YYYY YYYY . If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators. If you have filed an I-485, I-589, I-751, N-400, I-90, I-821, I-131 or I-765, you can expect to receive an appointment notice to appear at an Application Support Center to have your fingerprints and/or photographs taken. The timing of your appointment is determined by the number of applicants ahead of you that also need a biometric appointment. We try to schedule biometric appointments as quickly as possible and in most cases you will receive your appointment notice within 30 days of submitting your application. We will send your appointment notice approximately 14 days ahead of your scheduled appointment. It is important that you keep this appointment. If absolutely necessary, you can request that your appointment be rescheduled however, please be aware that rescheduling may delay the processing of your application. Please follow the instructions on your appointment notice if you need to reschedule. Occasionally, you may receive an appointment notice to appear at an Application Support Center to have your fingerprints taken when you have filed a form other than those listed above. In these situations, you may receive your appointment notice more than 30 days after submitting your application or petition.

San Francisco AOS interview
Hello,

I had my aos interview on 12/15/2017. The interview went well and the agent said she will approve my case after she does a background check. She did not stamp my passport with I-551 and said that it's reserved for cases where my card gets lost in the mail. She said not to worry and she will approve it by the end of the day and my card would arrive in the mail in the next two weeks.

It's been 3 days and the case status still says "Interview Is Scheduled". I have a new job lined up but can't take it on until this is approved ( I-765 pending after biometrics and I-130 still pending at receipt) I can't afford to have this delayed any more than 2-3 weeks and lose the job offer. My wife (citizen) and I are very worried about this and our future.

I don't understand what background check is being done and why she would say she will approve it by the end of the day if the background check is extensive. We are hoping it's just work load but even then why would they lie and say they will approve it by the end of the day when they have a huge case load. We explained my job offer situation to the agent and they seemed empathetic. I don't understand this.
