EB3 to EB2 Interfile when both are current?
Country India
PD: Aug 2011 (eb3 and eb2 both approved)

I have eb3 I485 pending since Oct 2020.
Now eb3 and eb2 are both current.
USCIS's new guideline published says to interfile to eb2.
But does this hold good for folks who have both eb3 and eb2 current?
Any benefit?

Approved!!
Hi all!
I just wanted to share my experience. I met my husband in Oct of 2018. We were married Dec of 2019. Since he was in the US already we filed a marriage based visa packet in Dec 2019. Then COVID hit and everything came to a halt. We expedited his work permit and this was approved in April 2020. He also was approved for a travel permit in May 2020. We received an interview notice for March of 2021. We had our interview, however we needed a couple of things so the officer said he would send an RFE. We received the RFE and I responded. we started to have some marital problems and in October 2021 I withdrew the application. Due to the withdrawal, we received a denial notice. In November 2021 we decided to give it another try and refiled the marriage based visa application ( basically starting from scratch). We received an interview notice in December 2021 for January 2022! ( unheard of). We had our interview 01/25/2022 and it turned out to be the same immigration officer who interviewed us the first time! ( what are the odds?). This time we were better prepared. Of course he asked about the withdrawal. We were very open and honest with him. He let us know that he was going to approve the application and it was approved the next day. We just received notice that card is being produced as of Feb 1st. I hope my story gives someone hope and DO NOT GIVE UP!!!

Most of y’all really need to save up and hire lawyer.. PERIOD!!!
I’m writing this through an experience.
My friend and her husband got married and they went a head to file and submit their application without a lawyer thinking they got all the paperwork right which I believe they did.
After filing, couple of RFE was sent to them which delayed their process and they ended up messing the whole process and stuff up. Now, it’s really looking bad for them and USCIS just sent them NOID after 3years of sending and receiving RFEs with not even a work permit.
Just know you can’t do this alone or by yourself. You need expects, some seasoned and well trained professionals(immigration attorney) to help from DAY 1 till it’s over. This journey is indeed stressful so why won’t y’all just hire attorneys to atleast take some of this burden and stress off your shoulder.
Reading most of the questions y’all be asking, sometimes breaks my heart and I ask “this is a question for an attorney or this person needs an attorney”. Guys this is important to us and I say it’s our future too so let’s shape and start by laying a great start!

I’m not an attorney but this is an experience I’ve witnessed and wants to let y’all know.

Good Luck and thanks to y’all.

Urgent Help with NOID
Dear sisters/Brothers
Received a NOID and was asked to present a verifiable Divorce Letter from Nigeria. Please does anyone has an idea of how to go about this, I submitted a divorce order from a Customary Court to USCIS in 2017. Now they’re asking that I provide another one because they couldn’t verify the previous divorce order I submitted. Please help me out, it’s quite urgent. Please share your experiences with me and how you think I should go about this. If you submitted a divorce order to them in the past and they accepted it please share your advice and which court in NIGERIA issued it for you.

Please help a brother.

Questions regarding I 130
Hi! I’d like to see if anyone can answer my question. My mom just got her green card recently and wants to petition for my brother who overstayed his visa in the US for 13 years. My brother entered the states legally but he overstayed, and he’s over 21 years old & still unmarried. In this situation, if the I-130 is approved and when his visa comes available in a few years, can he adjust his status in the US by just filing I 485 without leaving?(he’ll stay unmarried until then) Or how does it work? If you have similar experiences, please answer my questions if you could. And when submitting form i130 online, do we still have to attach passport photos? Thanks in advance
