E-Filing Procedure for applying EAD for L2
Hi
One week back, I joined my wife at TX. She is working here in a L1 Blanket Visa and I have joined her in L2. I want to work in US after obtaining EAD and SSN.

I have e-filied my EAD application I-765 3 days back. I am not sure what to do next. I am aware that I need to go to one of the nearest ASC office for recording biometric and I need to send supporting documents.

But I am not clear with order of action meaning, which one should be done first and which one should be next. Can Some one please help me with the complete step by step instruction in sequence in applying for EAD? Also correct me if I have was wrong anywhere in this process.

My I-485 Interview experience
The receipt date for my I-130 was December 2000. I was the beneficiary (child) of a permanent resident under the age of 21 as of that time (Family preference 2A). When i turned 21 years of age, my preference shifted to Family-sponsored preference 2B. My mother became a citizen in October 2006; thus, my priority date became current. I filed adjustment of status (I-485) in November 2006. I was scheduled for fingerprinting for December 12, 2006. I was contacted on December 21st, 2006 for additional information. I turned the requested information asap. In February 2007, i got an interview appointment letter for April 25th, 2007 at 0930.

The Interview:
All i can say is that it was an experience. USCIS has come a long way in Atlanta, GA. Things are done in a very orderly way.
I arrived the building at 9.10a.m. I got through security about 9.25a.m. It wasn't up to 30mins after checking in that my name was called. The lady was anything but friendly. She never looked at me or my mother. We greeted her; however, she chose not to respond. I really didn't mind. All i was praying for was a fair interview. She requested that we raise our right hand and swear to tell the truth. She went ahead to confirm my SSN, Place of birth, date of birth, address and parents' names. She requested for more documents (copies of prior immigration statuses), made copies of my mother's US passport and told us to go to the waiting room while she sorts out some issues. I got scared. She came out after about 15mins with my passport. Her words, "Your passport has been stamped with a temporary approval, you will get the permanent residency card in the mail in a couple of weeks"

Arrived from Grenada Feb. 1997, I.O. stamped I-94 Paroled exclusion hearing Aug. 1997(6 months) served I-122. Invalid documents 245(a)(i)(7) although I presented the I.O. with a multiple entry Grenadian PP and visa expiry 2006. At the time I was married to U.S.C.. Went to Aug. 1997 hearing with U.S.C. husband and filed I-122 and surrendered PP and visa. Hearing adjourned until Oct. 1997. Husband became incarcerated in between hearing dates. Didn't go back, panicked.(extraordinary circumstances?) Apparently exclusion and/or removal order was ordered in absentia by I.J. Here may be the catch. Originally arrived to U.S. in 1996 B1/B2 multiple entry Grenadian PP and visa expiry 2006, entry no problems, L.O.S. stamped 6 months. Had a long distance courtship with a U.S.C., married him in September 1996. He was incarcerated, getting out in January 1997. December 1996 unknowingly entered Canada with some friends one night, as I fell asleep in van, didn't have PP with me disallowed reentry to U.S. at border. Returned to Canada and detained by Canadian Customs. Friend brought PP and marriage certificate to me at detention center. Canadian Customs showed this to U.S. Customs at border but during detainment I-94 LOS expired. Deported from Canada due to "no visible means of support" returned to Grenada. Traveled to Barbados and Trinidad on same PP(no visa required) no problem. So what triggered I.O. to parole me for exclusion hearing upon reentry in 1997? Advance parole was not required because no AOS had been filed before I departed. Because I was deported from Canada there is no record of departure from U.S.? Left U.S. before LOS expired but no record of departure? U.S. may think I overstayed? HELP? Divorced and then remarried U.S.C. in 2000 and have 2 children and a good life but want to get green card and not live in fear of removal. PLEASE HELP. Thank you.

received approval for aos to permanant resisdence
The whole process was extremely short. i had previosely overstayed my J1 visa as an Au Pair.We got married on 11/11/2006, and received my green card approva1 on 03/21/07. just 4 months. I did all the paper work myself and everything went smooth. they received I-765 12/05/06 and the I-485 and the rest was received on 14 december 2006. went for 2 sets of fingerprints on 22 nov and 3 dec of 2006. had to wait the 3months for work authorization and it eventually arrived.got my interview date at the end of january 2007 for 21 march 2007. Went to the interview, it went really well the officer was so friendly and the only questions he asked was about the paperwork we had sent in and looked at wedding photos. I got my approval and my green card will be here in 2 weeks.

I-485
my husband and I have been together since 1998 we have a daughter born in 1999. We were both married once before and waited for divorces. got married in june 2003 filed I130 I485 and I765 in July. Receipt date august 2003. I765 approved fingerprinted december 2003 received ead March 2004. I485 interview May 2005 guy was friendly took all documents like taxes, marriage certificate, bank statements, took 2 pictures from wedding album,etc put everything into file.said I would have to do over fingerprinting because over 15mths old.New date May 2005 said everything ok wrote in passport pending his name and number said would get green card in the mail. in september 2005 received letter asking for results of medical since first report said hiv indeterminate. Sent in second result in October 2005. called uscis in february 2006 told by officer that still within limits should get card in june. received letter in june saying that I485 denied because they did not get results of second HIv test. had to file motion to reopen case. paid more lawyers fees went back to immigration doctor had to do over fresh medical had to pay again this time results said hiv negative same as results from my private doctor. met someone else in office who said he too had received results of hiv positive when he was hiv negative. doctor's assistant said they had been getting some wrong results. resubmitted physical plus new filing fee. 2 days after got email saying that I130 had been approved and I485 continued on June 19 2006. said that I would be notified when a decision was made have not heard anything since. Called uscis for information received a letter saying case had been denied on june 17 2006. meanwhile case status online said that fingerprint review was continuing. New case update said fingerprinting was completed and case was at missouri office and that I would be notified when a decision was made called uscis again for case status, received letter saying that I485 denied June 17 2006 same old letter. Meanwhile case status online says that case still being processed. Sorry to say my husband was diagnosed with cancer in december 2003. He passed away in August of 2006 still waiting for decision on I485 can't get social securith bendfits without green card can anyone who has been in this situation before please help

How long is the wait for background check after the I-485 interview?
I went to the I-485 interview in the USCIS local office in NYC on 2-28-2007. Everything went smooth. The officer was nice and she didn't ask us a lot of questions. She told us my case has not been goes trough the security check. She said we will be informed once the background check is done. She did not stamp anything on my passport BUT she wrote something on my passport with the A-number, case pending, the officer name who interview us, IR6, and the date of the interview.

Does anyone know what does all that mean? HOw long does my case usually take?

Biometric appointment
My husband had filed all paper work for my adjustment of status. We received noticed that immigration has already received the papers. December 20th i received the noticed to show up for my biometrics, but on the paper said if i wanted to reschedule to make a copy of the original with the desired date marked and mailed the original back.
my original appointment was on December 29th, I sent the noticed right back to them on december 22, i havent received anything else.. I went to the office where the appointment was going to be with the copy of the notice and my passport, and they were rude, all i wanted to know was if i will get anything in the mail for a new appointment. I showed up there anyway because i thought they may had not got the original with the change of date request.. I cant find a number to call the USCIS site has no place to put a A# receipt number that is what shows on my notice.. the place where the biometrics are taken has no phone number to call.
DO i get something in the mail. does it take long for them to mail me back with a new date.?? anyone know.. please let me know..

When the non-immigrant status change?
Hi,

I hope there's at least one person who can help me with my doubts about my current status.

I came to NY on B2 visa, get married and decided to start the Adjustment of Status procedure by filling the I-130 petition together with I-485.

I-130 has been approved. Has it changed my status, if so, in what way?

Does it have any impact on my tourist visa?

My B2 visa expires soon so if I've already started adjustment of status procedure, am I allowed to stay in the country longer and what would be my status after my tourist visa expires? Would I be able to get Advance Parole if needed?

Generally speaking, is my tourist visa still applied or are there any changes in my status (B2 status).

Waiting for EAD and AOS approval
My AOS packet was recieved at Chicago Lockbox facility on Oct 24,2006. On Nov 2 i received I-797 Notice of Action for both EAD and I-485. I understand that since late summer of 2006 the process for Adjusting Status has been moving rather quickly.I live in Tampa,Florida and am married to a USC and I-130 was approved in Sept of 2006.

I am trying to find out any information of how long I am expected to wait for both my EAD to arrive and for my AOS interview. I contacted a local immigration services agency a month ago and the employee told me that the AOS process is moving really quickly, so quickly that one doesnt even have to file for an EAD which I did anyway.Any relevant info would be greatly appreciated on this matter.Thank You.

I and my husband had the most horrendous experience at the immigration office.
Let me start from the beginning, Four years ago this coming May I met the most wonderful man, kind generous, loving, compassionate, caring, and peaceful, no temper, not mean and wouldn’t hurt a fly. As time went by this friendship turned into love and very much in love we are. We got married on February 14th 2005. I have been married before twice, my fist marriage, I was 18 was one of the biggest mistakes I have made, he was an alcoholic and beet me a few times ended up in a divorce. My second marriage I married a man from Indonesia I believd everything he told me after we got married he changed, he was very thretening to me and very mean to my children, not very dependable and disapered for months onend. of course this ended in divorce also. For twenty years now I’ve worked as a waitress providing for my four children, on and off the welfare system paying taxes, not rich but get by. I’m a law abiding citizen, I love my country. And I love my husband very much.
Before he came into our lives it was nothing but turmoil, I worked 60+ hours a week my children were babbysat by family, never had time with them, my son is diagnosed with severe ADHD, obsessive compulsive disorder, anxiety disorder, and bipolar disorder, his whole life he has been in and out of institutions (not a very pleasant childhood) but I did what the professionals advised me to do. And me being a single mom it was a very stressful life, I became dependent on alcohol. I was in a downward spiral for years. Then I met my soul mate and he is the best thing that has happened in our lives. He Has taught us how to live and love life I no longer work 60+hours and I’m able to be home with my children. Were I needed to be for years, and now I’m able to do so, we brought my son home in the summer of 2005 and he has done wonderful in school and at home, this has been the most successful year he has ever had in school and at home. I no longer depend on alcohol to get by. He has taught us so much, love friendship, peace and happiness, my children adore him and my son wants in to adopt him, he loves him so much.
Well after we got married in Feb.2005 we went to a lawyer and filed all the necessary documents for him to be a permanent resident (from Turkey) he got his EADcard in June of 2005 and had interview at the immigration office in September of 2005 that went very well but interviewer needed us to get a joint sponsor, well needless to say we live in a very rural are in va and it is not to easy to find someone financially able to have the extra Burdon of being financially responsible for another human being. We went to my parents but they are barley getting buy and weren’t qualified, my brother just started his own bus and wasn’t qualified, my brother in law was in the same situation also, my sister and husband we going to help but the were in the middle of adopting another child. I finally found a friend but that also fell through. So my lawyer asked for a couple of continuants and I finally found someone and turned in all the information needed I January of 2006, this was the only thing we were waiting for.
April of this year we filed a renewal for his EAD card , because his would expire in June of 2006 and we didn’t want that to happen, well we got a approval letter stating that our application for employment authorization has been APPROVED dated 05/02/06 and that he had an appointment on 05/15/06 at 10.00am from Interim District Director of Services , when we got there my husband went in I had to stay in the car because I had left my drivers license in my car but he new what to do and I made sure he had all of the documents they asked for, after about ten minutes two agents came out to our car and got me saying my husband needed me because he couldn’t understand what they where telling him. When I went inside they took me back to a room were my husband and another agent were sitting. And they handed me another letter stating that his application for residencies had been denied I almost passed out, totally floored I was hysterical they told me they were going to send my husband back to Turkey, or we could go in front of a judge and have him determine the case, they told me that we would have to pay $5000 in fines and his bail would be $5000 you couldn’t imagine what was going through my head thank god our lawyer was there at an interview with another client. And she came back immediately and had all the fines dropped and released on his own recogenence promising he would show up in court on the date they send us. I feel this was entrapment, we came for an appointment that they scheduled, that was the worst experience of my life I was so scared and so was he they put shackled on his feet and processed him as thought he was a hardened criminal. Then began to interrogate me asking about our age different trying to turn me against the man that I truly love and he loves me as well, I am a us citizen pay my taxes vote how can my country do this to one of there own people I thought this was the land of the free but im not free to marry whom I choose and is not allowing me a united states citizen to have her constitutional rights. There taking my rights away from me and my children you are telling me who I can’t and can love ,honor and cherish what kind of freedom is that.
My husband entered the United States legally, he did however overstay his visa but now for over a year now he has been trying to make it right and doing everything the immigration office has asked. The only hold up was the joint sponsor and believe me these days with how messed the economy is that is a hard task to do but I did finally found a kind heart to do that. When we go in front of the judge and my husband does get deported this will not only be going against my constitutional rights it would be violating my children’, my parents, my sisters, my brothers, my sister in-laws, my brother in-laws, my nieces and nephews and all our friend that absolutely adore my husband. And no telling what affect it would take on my children are you going to send my son on another downhill spiral back to an institution? Me back to the bottle? Back to welfare? Let alone how much it’s costing the government to do all of this. This just doesn’t affect him, me and the children it affects the entire community and state. Please I’m pleading for help I love my husband and he loves me Please do not take him from my family,as af Nov 1st we still don't have a court date and he still has not been able to work for the past 6 mo how much longer are we going to have to wait. i am now working all the time know i'm the soul provider for the family. any suggestions or advice is welcome.
