j1 visa subject to 212
hi all ,
? want to share my j1 visa waive experience .? came to U.S.A with j1 visa subject to 212 (US government financed ) and it is one of the hardest visa type to waive it .
it was a 18 months training program and the rule on visa says after 18 months ? have to go back to home counrty and stay there 2 years. the year ? came here was 2009!
after my j1 visa expired ? didnt go back to my home country and then met with my wife and married .
after a while we applied for green card without any lawyer help.we thought after married j1 would be automatically waived.but of course it wasnt right.
after we went to interview the officer told us everything looks fine but because of my 2 years rule they can not approved my green card.
ok we decided to waive the j1 waive based of hardship and waited about 7 months for that.
during this process they request for evidence for 2 times and we sent all.
we got a letter in the mail box after 7 months and says its denied because not enough evidence for hardship and give a 30 days deadline for file the forms again.it was a really short time and we didnt know what to do.we talked with a few lawyers and they all told us its a really short time we cant not help just wait after 30 days they may call you to court for this.and they wanna help during this court and asking crazy amount of money.but we didnt believe any of those lawyers because we knew that they wanna take advantage of our situation.
after 1 year we found a lawyer that we can trust and he was really professional the way he asked questions about my j1 visa.
so long story short we applied to waive the j1 visa with no objection letter this time and it took about 4 months and it has been waived.

? just wanna say from here nothing is impossible lots of lawyers told me my j1 visa is based on US government finance and its the diffucult one almost impossible even ? tried first with hardship it didnt work and then no objection letter been approved.
all we need to find right lawyer and be patient about this visa process times.
hope my long processing time will help some of people who is in the same situation that ? was before
