CAN I FILE FOR MY EX-WIFE WHOM I HAVE NOW RE-UNITED WITH?
About 5 years ago i got a united state visa together with my wife and daughter. but a year later, we got divorced. during one of my stay in the usa, i run into a lady and we fell in love and got married as a result of which my status was upgraded to a resident ( at this time i presented my divorced cerificate). Recently my wife started seeing her ex-boy friend and its bringing a swepration between us. at the same time, there is pressure back from africa of the need for me and my ex-wife to re-unite for the sake of our two kids (african tradition).

NOW, my WORRY IS, can i re-unite with my ex-wife and file for her to join me in the united state of america??
will immigration accept the fact that our divorce and my marriage to a usa citizen and got a green card was in good faith?, and now am coming back to re-marry her and file for her to join me?

How should i go about this?

USCIS been approved my case since jan 7 2015 and sent it to nvc jan 15, since then, i dont have any information from NVC, send so many message no reply from them. just tired. any information please

!-130 Processing
Just trying to get a feel as to the time process for the I-130. I (petitioner) submitted the I-130 (for my spouse whom I married in Spain) and recieve back my I-797C Notice of Action with reciept date of 15 December. I have registered for email and text notifications and so far I have heard nothing. Processing time for Nebraaka Service Center says 5 months.
Quetsion: Is the next step for them to contact my spouse in Spain ocne the NVC? Is 5 Months a good time asssesment?

HELP!! WE ARE APPYING FOR A MINOR CHILD HAVE QUESTIONS
eMy husband is filing for his daughter, we have not been saving his receipts to prove he has been supporting her. My question is will we be denied if we submit the application and send proof that he sends money home when we get a few receipts saved or should we wait to submit them all at once? I read they may deny us if we do not submit all the information requested.

Form I 864 Tax returns filling jointly, income separation, errors. Help?
hi everyone, I need help on my difficult situation in filling affidavit of support form. I have a sponsor who filled tax returin together with his wife but she refuses in sponsoring me. Last time I sent w2 forms from my sponsor , w2 wage and tax statement, w2 and ernings summary, pay stubs and 1040a wich they filled jointly. NVC wants adjusted gross income and it should match with the income in affidavit of support.
[x] In Part 6. Sponsor's Income and Employment, please correct the following...
[x] Item 5. You must enter your current individual annual income. This means the amount of money you expect to earn
during the current calendar year.
[x] Item 10. The current annual household income must equal the sum of items 5, 6.c., 7.c., 8.c., and 9.c.
[x] Item 13.a. You must include your _2013_ tax and income information.
[x] Items 13.a.1. The income you enter must match the total (gross) income reported on your most recent Federal
income tax return. If you filed Form 1040EZ, use the adjusted gross income instead.?

Hovewer some errors are ridiculous because I entered his individual annual income, and there was tax income information for the 2013 year. However how the income that I entered from my sponsor could match total gross income reported on his most recent tax return if this tax return was filled jointly with his spouse?? thank you for any suggestions in advance. Please help?

My aunt has filed petition file of F4 category for my mom. Filed petition on 6 Aug 2002, and on June 5,2014 we received a letter telling your immigrant visa is now eligible for further processing at National Visa Centre. Now,

NVC Case number is YYYY YYYY XX013
INVOICE ID NUMBER YYYY 1199
BENEFECIARY ID NUMBER YYYY XX39.

Now, the letter says to complete DS261 form and proceed further. But when we saw on site there were 3 names in it. My mothers name, fathers name and sisters name as she is below 21.
My age is 22 and so it is considered as age out. That is true. So it was not there. On the contrary the person handling our documents calculated under cspa calculator and found that I am eligible under that law for visa.
Here is the details.

DOB--- 11/25/1992
PRIORITY DATE ----- 07/2002
APPROVAL DATE OF PETITION-----9/11/2007
VISA BULLETIN CURRENT DATE----- 12/22/2001

So when the petition was filed I was 9 years of age. So we have sent an application regarding cspa to USCIS and I want to know what should we receive in terms of acceptance that our cspa is confirmed. I am very tensed and we have waited for this from 14 years. So please provide me further steps on how to go forward and how to handle and proceed to cspa. Please be needful.

joint sponsor is a military
Hello.
First of all, let me thank you for all your posts on this forum. They have helped me gather my documents for an AOS. Now, I'm about to send the package to USCIS but there's only a missing document: a I-864 from a joint sponsor. The joint sponsor is already found. He is a military. I told him he needs to show letter of employment, paystubs for the last 6 months, IRS transcript for the last 3 years, proof of residence in US, copy of certificate of naturalization or US passport. But He responds that He does not need to submit all those documents, that He will give me a LES(paystub summary for military) that shows all his activities, situations in US. he will also give me the last IRS transcript and a copy of his passport. but no letter of employment since the LES is a proof of military in duty. Is what he said correct and sufficient? Please help!
Another issue is that , He has sponsored his wife green card 3 years ago. His wife has never worked in US since , She only goes to school. Can He still support me also? His income is about 60K. Thanks in advance for your help!

I filed the forms for my wife on Aug 1, 2014, On October 3, I get a letter requesting more information about our marriage. The latest date to respond is November 28, 2014. Today, I get an email with the following message

Application Type: I130 , IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

Your Case Status: Post Decision Activity

On October 6, 2014, your notice I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN was processed and mailed to the address on record. If you have not received it within 30 days of October 6, 2014, contact customer service at 1-800-375-5283. If you move while your case is pending, please call our customer service center at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

I have not received anything saying if it was approved or denied. So what is going on here????

I-130 Approved in 2002
Hello All. I have a question. I had an I-130 approved in 2002 but had 245-i denied because i apllied after the cutoff date od april 01. Now 12 years later i wanna restart the process and apply for a 601 waiver and try my luck. I have been married to a US Citizen for 12 years and we have a daughter together who is about to turn 13.
Now question is do i have to reapply for petition I-130 again??? i have read that once approved I-130 is valid forever but my lawyer tells me i need to reapply since the all process was terminated?

I appreciate any info from anyone who has been through this,.
