    Hi,

    My husband has been sponsered by his parents under the I 130 visa petition for permanent residence in the USA.

    The petition is on the verge of an approval anytime now, with correspondence from the US immigration already in process. However, in between, we got married and thus the marital status has changed from that which was mentioned for my husband while filing I130.

    I would like to know whether his immigration application remains cancelled under such circumstances (change in marital status) or is there a way out where in i can join him on a different visa and he can go ahead with the same application for permanent residence in the USA.

    We both (me and my husband) are located in India and he has never travelled to the USA.

    Kindly update me on any information that could possibly help us in such a situation

    I-130

    IF his parents petitioned for him as PR and he is now married then his I-130 is considered invalid. If his parents become U.S. citizens and re-petition him he will fall under F3 and then you will qualify for follow-to-join benefits when the a visa becomes available.
